Texte source - hongrois Elfogadta a parlament a panaszokról és a közérdekű bejelentésekről szóló törvényt. A Transparency International Magyarország (TI) szerint a törvény nem segíti a korrupció felszámolását, ráadásul nem védi kellően azt, aki korrupcióra bukkan, és azt bejelenti. Ezért arra kérjük Áder János köztársasági elnököt, hogy ne írja alá a törvényt.
A (TI) már a törvényjavaslat előzetes változata kapcsán kritikus véleményt fogalmazott meg. A közigazgatási egyeztetésre bocsátott első változatot megelőlegezett bizalommal továbbgondolásra alkalmas próbálkozásnak neveztük. A parlament által tegnap elfogadott törvény azonban nem más, mint a korrupció ellen fellépni hajlandó polgárok megvédésére tett alkalmatlan kísérlet.
A TI által 2012-ben és 2013-ban végzett korrupciós felmérések kimutatták, hogy Magyarországon az emberek 70%-a nem jelentené a hatóságoknak, ha korrupciót észlelne, ami nemzetközi összehasonlításban is megdöbbentően rossz arány. Az emberek zöme közömbös a korrupciós esetek iránt vagy fél. Amikor a korrupcióval szembeni társadalmi közöny ilyen méreteket ölt, kizárólag az újszerű és hatékony megoldások hozhatnak áttörést. Az előző kormány elképzelése az volt, hogy a bejelentő-védelmi hatóság felállítása és a tisztességes eljárás védelmét szolgáló különleges eszközöket szabályozó törvény jelent megoldást. Nem tudjuk, hogy ez hatásos lett volna-e, ugyanis ezt a törvényt soha nem alkalmazták, a most elfogadott új szabályozással pedig formálisan is hatályon kívül helyezték.
A jelenlegi kormány nem osztja elődjének elképzeléseit, nem hoz létre korrupció elleni új csúcsszervet. Ehelyett a meglévő hatóságokat, vagyis a rendőrséget, az adóhatóságot, az ügyészséget, a számvevőszéket, stb. kötelezi a közérdekű bejelentések kivizsgálására. Ezzel azért nem értünk egyet, mert a meglévő intézményrendszer és a jelenleg alkalmazott eljárások számos korrupciós jelenséget hagynak szabadon virágozni. Például évtizedek óta következmények nélküli az egészségügyben a hálapénz rendszere, és a pártok kampánykorrupciója is csak a sajtót és egyes civil szervezeteket foglalkoztat, a nyomozó hatóságokat azonban nem. Több, mint naivitás lenne azt feltételezni, hogy a most tétlen hatóságok, pusztán azért, mert újabb törvény utasítja őket cselekvésre, érdemben foglalkozni fognak a korrupció ilyen kényes megnyilvánulásaival.
Egyedül azt tartjuk előrelépésnek, hogy a törvény értelmében az ombudsman vizsgálódhat azoknál a hatóságoknál, amelyek vonakodnak eljárni a közérdekű bejelentések ügyében. Mivel azonban az ombudsmani megállapítások nem kötelezik a mulasztó hatóságokat, áttörés ettől a megoldástól sem remélhető.
Az új törvény a korrupciót, visszaélést bejelentő polgárok hatékony védelméről sem gondoskodik. Aki fellép a korrupció ellen, veszélynek teszi ki magát és a környezetét, elveszítheti az állását, ha vállalkozó, eleshet a megrendelésektől, súlyosabb esetekben a testi épségét, életét is kockáztatja. Az új törvény nem vesz tudomást ezekről a veszélyekről. Védelemben csak a közérdekű bejelentő részesülne, vagyis családtagjai és más hozzátartozói például nem.
A bevezetni tervezett bejelentő-védelmi támogatás ráadásul pusztán anyagi jellegű segítség lenne, vagyis a törvényjavaslat nem gondoskodik a bejelentő vagy hozzátartozói fizikai, személyi megvédéséről. Az is komoly hiányossága a törvényjavaslatnak, hogy hallgat a kilátásba helyezett anyagi támogatás minimális összegéről.
Pedig a korrupció elleni sikeres fellépéssel kevesebb közpénz áramolna ki az állami büdzséből. Méltánytalan azt elvárni egy adott esetben magas beosztású dolgozótól, hogy a közérdekű bejelentéssel kockáztassa a megélhetését, ha cserébe csak csekély mértékű állami segélyre számíthat. A közérdekű bejelentők anyagi támogatásának arányban kell állania a bejelentést megelőző jövedelmükkel.
Súlyos jogalkotói mulasztás az is, hogy a korrupciót bejelentők nem részesülnek védelemben a jogellenes felmondással, vagy a felfedett államtitok, üzleti titok megsértése miatt történő felelősségre vonással szemben.
Ilyen rendelkezések hiányában puszta deklaráció marad az a rendelkezés, miszerint a közérdekű bejelentővel szembeni minden hátrányos intézkedés jogellenesnek minősül.
Az új törvény valójában semmilyen módon nem kezeli azt a helyzetet, amikor a korrupciót bejelentő polgárt megtorlásként például eltávolítják az állásából. Nemcsak, arról van szó, hogy a pórul járt polgár a saját költségén kénytelen pereskedni a volt munkáltatójával, ha elégtételt akar, de még azt is neki kell bizonyítani, hogy a felmondás jogellenes volt.
A Transparency International Magyarország ezért arra kéri a köztársasági elnököt, hogy ne írja alá a panaszokról és a közérdekű bejelentésekről szóló törvényt, hanem küldje azt vissza megfontolásra a parlamentnek. Részletes szakmai érveinket itt olvashatja.
Traduction - anglais The Hungarian Parliament adopted the act on complaints and announcements of general interest. Transparency International Hungary (TI) believes that the law does not facilitate the eradication of corruption, moreover; it does not provide adequate protection for those who encounter corruption and report the incident. Therefore, we call on János Áder, the president of the Republic, to refuse signing this law.
TI has already expressed a critical opinion of the draft legislation. We expressed our confidence in the first draft submitted for administrative consultation referring to it as an attempt worth further consideration. However, the law adopted yesterday by Parliament is, in fact, nothing more than an incompetent effort to protect citizens who are willing to defy corruption.
Corruption surveys conducted by TI in 2012 and 2013 revealed that 70% of people in Hungary would not report corruption to authorities, which is a staggeringly high figure even in international comparison. The bulk of people are either indifferent to cases of corruption or they are afraid. When social indifference towards corruption reaches such a magnitude, only novel and effective measures are able to bring a breakthrough in the situation. The previous government envisaged addressing the problem by establishing an authority charged with the task of protecting whistleblowers and by passing the Act on The Protection of Fair Procedures. We will never know whether these would have brought an effective solution because the law was never applied and with the adoption of the new legislation it has now been repealed formally as well.
The government in power does not share the vision of its predecessor; it does not intend to set up an new anti-corruption organ. Instead, it obliges existing authorities, i.e. the police, the tax authority, the public prosecution, the audit office etc. to investigate announcements. We do not agree with this measure since the present institutional system and currently applied procedures let several forms of corruption flourish. For instance, the payment of gratuity money in the health care system has been in practice for decades without any consequence, and only the press and certain NGOs are concerned about corrupt party campaigning but not the police. It would be more than naivety to suppose that currently passive authorities would suddenly start tackling these sensitive manifestations of corruption effectively just because yet another law requires them to act.
The only progress the new law brings is that the ombudsman may launch an inquiry into the practice of authorities which refuse to act upon announcements of general interest. Yet not even this measure can be expected to deliver a breakthrough since the conclusions of the ombudsman are not binding for the negligent authorities.
The new law also fails to provide effective protection for whistleblowers. People defying corruption might put themselves and their environment in jeopardy: they can lose their job; if they are entrepreneurs, they can lose orders; in worse-case scenarios, their physical safety or even their life may be put at risk. The new law ignores these potential risks. Protection would only be granted to whistleblowers, but not so to their families and other relations, for example.
Moreover, the special support intended for the protection of whistleblowers would only represent financial help, which means that the bill does not provide for the physical and personal protection of whistleblowers and their families. Another major shortcoming of the proposed legislation is that it stops short of defining a minimum amount of support.
However, successful action against corruption would result in less public money leaking from the state budget. It is unreasonable to expect a high-ranking employee, for example, to risk their livelihood by blowing the whistle, if all they can hope for in exchange is a humble state subsidy. Financial support granted to whistleblowers must be proportionate to the income they earned before reporting an incident.
The fact that whistleblowers do not enjoy protection against wrongful dismissal, or prosecution for disclosing state secrets or breaching business secrecy amounts to another major legislative deficiency.
In lack of such measures, the provision stipulating that any discriminatory act against whistleblowers constitutes a violation of law remains but a mere declaration.
In fact, the new legislation fails to address, in any way, situations in which whistleblowers reporting corruption are, for instance, removed from their job by way of retribution. Not only does the misfortunate citizen have to bring their employer to court at their own expense if they want to be compensated, but the burden of proof also rests with them.
Therefore, Transparency International Hungary calls on the president of the Republic to refuse signing the act on complaints and announcements of general interest and to refer it back to Parliament for reconsideration. Pull position paper can be accessed here.

Nem tudja hogy kezdjen hozzá? Szigetelje úgy otthonát, hogy az évtizedekre megoldást jelentsen!

Egy példa: egy 70-es években épült, több mint negyven éves típusház éves energiaköltsége körülbelül 635 ezer forint. Egy átgondolt felújítással ezt az összeget akár 230 ezer forintra is lecsökkentheti!
Mire figyeljen oda, ha szigetel?
Az U érték megmutatja, mennyi hő szökik el. Minél alacsonyabb az U- érték, annál jobb! A külső falak maximális U-értéke 0,45 de lehet, hogy az Ön otthonához a 0,3-as érték megfelelőbb.
A szigetelés vastagságán nem érdemes spórolnia – egy vastagabb, de jobb szigetelés alig kerül többe. A falakon használjon legalább 8-12, a tetőn pedig 20-25 cm szigetelést!
Kérdezzen utána: melyik az otthonához illő szigetelőanyag: a polisztirol, a kőzetgyapot, az üveggyapot, vagy a cellulóz alapú!
Vásároljon teljes szigetelőrendszert, azaz használja a gyártók által ajánlott rögzítőanyagokat, ragasztókat, védőhálókat és vakolatot!

Hogyan akadályozható meg a vizesedés.

What do you need to watch out for when insulating your home?
The U value shows the rate of heat loss. The lower the U value, the better the insulating quality! The U value of exetior walls should not exceed 0.45 but your house might require a 0.30 U value.
It’s not worth saving money on the depth of insulation: thicker but more efficient insulation barely costs more. The recommended tickness of insulation is 8-12 cm for walls, and 20-25 cm for the loft.

Buy a complete insulation system. Use fixatives, adhesives, insulation support nets and plaster recommended by manufacturers.
