1. Préambule

[X] propose des Prestations touristiques en son nom et pour le compte de ses fournisseurs.
Les présentes conditions générales régissent les Commandes que tout Client peut passer par téléphone et sur le Site.
L’utilisation du Site et la gestion des données à caractère personnel des Clients sont régies par la Politique de Confidentialité que le Client reconnaît avoir lue et acceptée séparément.
Les conditions applicables à toute Commande sont constituées des présentes conditions générales, des dispositions impératives du Code du Tourisme et des conditions particulières figurant sur le descriptif de la Prestation et sur le Formulaire d’information et de réservation accessible avant la confirmation de Commande qui inclut les informations requises par la réglementation applicable et notamment les caractéristiques principales des Prestations, les disponibilités, les options et les prix applicables. Le contrat conclu entre [X] et le Client est formalisé par l’email de confirmation et ses pièces jointes (Conditions générales de vente, Fiche Produit et conditions d’assurance si le Client y a souscrit) ainsi que les documents de voyage communiqués au Client lors du paiement intégral de la Commande.
Pour toute Commande passée sur le Site égale ou supérieure à 120 euros, [X] garantit au Client un accès permanent à l’écrit qui le constate via son compte ou sur demande écrite à [X] et ce pendant une durée de 10 ans à compter de la date du voyage réservé.
Les présentes conditions générales régissent les ventes de Prestations réservées à compter de la date figurant ci-dessus. Pour toute Commande passée avant cette date, le Client
devra se référer aux conditions générales de vente accessibles sur support durable dans son email de confirmation de commande.

[X] is the sole publisher of the Site and sales are made on behalf of [X], a simplified joint-stock company with a capital of€426,247.
1. Background
These general terms and conditions govern the sale of Services made by [X], a simplified joint-stock company with a capital of €426.247, whose registered office is 10 rue de Penthièvre 75008 Paris, is registered in the RCS of Paris (France’s company register) under number 818 188 385, and is registered with Atout France (France’s national tourism development agency) under number IM075160071. [X] (VAT number FR 52 818 188 385) holds a financial guarantee provided by GROUPAMA ASSURANCE-CREDIT, 8-10 rue d’Astorg, 75008 Paris, said guarantee covering all the jurisdictions into which the Services are sold, and [X] holds public liability insurance provided by HISCOX EUROPE UNDERWRITING LIMITED, 19 rue Louis Le Grand, 75002 Paris, said insurance covering damage caused to third parties as a result of its travel, holiday and ticketing sales activities.
[X] offers tourism Services on behalf of itself and its suppliers.
These general terms and conditions govern Orders that any Customer may place by telephone or on the Site.
The use of the Site and the management of Customer personal data are governed by the Privacy Policy which the Customer acknowledges to have read and accepted separately.
All Orders are subject to these general terms and conditions, to the mandatory provisions of the Tourism Code and to the specific terms and conditions to be found in the description of the Services and in the Information and Reservation Form that may be accessed prior to confirming the Order. This form includes the information required by relevant regulation and, in particular, the main characteristics of the Services, their availability, relevant options and prices. The contract concluded between [X] and the Customer is formalised by the confirmation email and its attachments (general terms and conditions of sale, product sheet and insurance terms and conditions if the Customer has taken out cover) as well as by the travel documents sent to the Customer at the time of payment in full of the Order.
With regard to any order placed on the Site equal to or greater than 120 euros, [X] guarantees the Customer permanent access to the written order document via his account or upon written request to [X] for a period of 10 years from the date of the booking of the journey.
These general terms and conditions govern sales of Services booked from the above date. With regard to Orders placed prior to this date, the Customer should refer to the general terms and conditions of sale which may be accessed on a durable medium in their order confirmation email.

Faits et procédure
1. Selon l’arrêt attaqué (Paris, 26 juin 2019), rendu en référé, et les productions, M. X... a été mis en examen, le 27 janvier 2016, du chef d’atteintes sexuelles sur des mineurs qui auraient été commises entre 1986 et 1991 alors qu’il était prêtre dans le diocèse de Lyon. Il a également été entendu en qualité de témoin assisté concernant des viols qui auraient été commis au cours de la même période.
2. Par acte du 31 janvier 2019, il a assigné les sociétés Mandarin production, Mars films et France 3 cinéma en référé aux fins, notamment, de voir ordonner, sous astreinte, la suspension de la diffusion du film « Grâce à Dieu », prévue le 20 février 2019, quelle qu’en soit la modalité, jusqu’à l’intervention d’une décision de justice définitive sur sa culpabilité.

3. En application de l’article 1014, alinéa 2, du code de procédure civile, il n’y a pas lieu de statuer par une décision spécialement motivée sur ce grief qui n’est manifestement pas de nature à entraîner la cassation.

4. M. X... fait grief à l’arrêt de rejeter sa demande, alors :
« 1°/ que le droit à la liberté d’expression doit s’exercer dans le respect de la présomption d’innocence ; qu’en jugeant disproportionnée une mesure de suspension temporaire de la diffusion du film Grâce à Dieu, dont elle relevait elle-même qu’il avait « nécessairement pour conséquence de rappeler l’existence des faits pour lesquels A... X... a été mis en examen, dans des circonstances telles que la réalité des faits n’apparaît pas contestable », bien qu’elle n’ait constaté, ni la nécessité pour le cinéaste de porter atteinte à la présomption d’innocence de M. X... ni l’existence d’un quelconque risque que la mesure demandée paralyse le débat d’intérêt général auquel le film vient contribuer, la cour d’appel a violé les articles 9-1 du code civil, 6, § 2, et 10, § 2, de la Convention de sauvegarde des droits de l’homme et de libertés fondamentales ;
2°/ que chacun a droit au respect de la présomption d’innocence, qui implique de ne pas être publiquement présenté comme coupable ; qu’en l’espèce, la cour d’appel a expressément constaté que la réalité des faits imputés à M. X... dans le film Grâce à Dieu y était présentée comme certaine ; qu’en relevant cependant, pour écarter la gravité de cette atteinte portée à la présomption d’innocence, qu’à la fin du film, un carton indique que « le père X... bénéficie de la présomption d’innocence » et qu’« aucune date de procès n’a été fixée », ce qui « rappelle aux spectateurs la réalité du contexte juridique et judiciaire », sans tenir compte de l’impact particulier d’un film comparé à celui d’un message écrit apparaissant quelques secondes à l’écran, la cour d’appel a violé les articles 9-1 du code civil et 6, § 2, de la Convention de sauvegarde des droits de l’homme et des libertés fondamentales ;
3°/ que chacun a droit au respect de la présomption d’innocence, qui implique de ne pas être publiquement présenté comme coupable ; qu’en se fondant également, pour écarter la gravité de l’atteinte portée à la présomption d’innocence bénéficiant à M. X... , sur le sujet du film, « qui n’est pas un documentaire sur le procès à venir » et relate « le vécu de victimes qui mettent le prêtre en accusation, qui expriment leur souffrance et qui combattent contre la pédophilie au sein de l’église », bien qu’elle ait elle-même constaté que ce choix avait précisément pour effet de présenter la culpabilité de M. X... comme incontestable, la cour d’appel a violé les articles 9-1 du code civil et 6, § 2, de la Convention de sauvegarde des droits de l’homme et des libertés fondamentales ;
4°/ que le caractère partiellement fictionnel d’une oeuvre de l’esprit ne réduit pas l’atteinte susceptible d’être portée au droit à la présomption d’innocence, lorsqu’une personne réelle y est présentée sans réserve comme coupable d’actes faisant l’objet d’une procédure pénale ; qu’en se fondant également, pour écarter la gravité de l’atteinte portée à la présomption d’innocence bénéficiant à M. X..., sur le fait que le film Grâce à Dieu « débute sur un carton indiquant « ce film est une fiction, basé sur des faits réels », informant le public qu’il s’agit aussi d’une oeuvre de l’esprit », sans constater que la culpabilité de M. X... y serait clairement présentée et identifiée par le spectateur comme fictive, la cour d’appel a violé les articles 9-1 du code civil et 6, § 2, de la Convention de sauvegarde des droits de l’homme et des libertés fondamentales ;
5°/ que l’expression publique d’un préjugé tenant pour acquise la culpabilité d’une personne pénalement poursuivie comporte en elle-même un risque d’influencer la juridiction appelée à juger, indépendamment de la composition de celle-ci ; qu’en retenant que « si un renvoi devait être ordonné, il le serait devant une juridiction correctionnelle, et donc devant des magistrats professionnels dont l’office est de s’abstraire de toute pression médiatique, de sorte que le propos du film n’est pas de nature à porter atteinte à son droit à un procès équitable », la cour d’appel a violé les articles 9-1 du code civil et 6, § 2, de la Convention de sauvegarde des droits de l’homme et des libertés fondamentales ;
6°/ que l’impartialité du juge exige que les tribunaux soient perçus par les justiciables comme les seules instances aptes à juger de la culpabilité d’une personne pénalement poursuivie ; qu’en retenant que « si un renvoi devait être ordonné, il le serait devant une juridiction correctionnelle, et donc devant des magistrats professionnels dont l’office est de s’abstraire de toute pression médiatique, de sorte que le propos du film n’est pas de nature à porter atteinte à son droit à un procès équitable », bien que le simple fait de laisser la culpabilité d’une personne poursuivie pénalement faire l’objet d’une démonstration publique, avant tout procès, suffise à porter atteinte à l’exigence d’impartialité du juge, la cour d’appel a violé l’article 6 de la Convention de sauvegarde des droits de l’homme et des libertés fondamentales ;
7°/ que chacun a droit à un procès équitable ; qu’en retenant que « la sortie du film à la date prévue n’est pas de nature à constituer une atteinte grave au caractère équitable du procès et à la nécessité d’assurer la sérénité des débats devant le juge pénal, étant observé qu’il en irait autrement si la sortie du film devait coïncider avec les débats judiciaires », sans rechercher si la possibilité offerte à tous de télécharger ou d’acquérir une copie du film, pendant le procès, n’est pas, quant à elle, de nature à porter atteinte au droit de M. X... à un procès équitable, la cour d’appel a privé sa décision de base légale au regard des articles 9-1 du code civil, 6, § 2, et 10, § 2, de la Convention de sauvegarde des droits de l’homme et des libertés fondamentales. »
Réponse de la Cour
5. Selon l’article 6 de la Convention de sauvegarde des droits de l’homme et des libertés fondamentales, toute personne a droit à un procès équitable et toute personne accusée d’une infraction est présumée innocente jusqu’à ce que sa culpabilité ait été légalement établie.
6. Selon l’article 10 de cette Convention, toute personne a droit à la liberté d’expression mais son exercice peut être soumis à certaines restrictions ou sanctions prévues par la loi qui constituent des mesures nécessaires, dans une société démocratique, notamment à la protection de la réputation ou des droits d’autrui pour empêcher la divulgation d’informations confidentielles ou pour garantir l’autorité et l’impartialité du pouvoir judiciaire.
7. En vertu de l’article 9-1 du code civil, le juge peut, même en référé, sans préjudice de la réparation du dommage subi, prescrire toutes mesures aux fins de faire cesser l’atteinte à la présomption d’innocence. Une telle atteinte est constituée à condition que l’expression litigieuse soit exprimée publiquement et contienne des conclusions définitives tenant pour acquise la culpabilité d’une personne pouvant être identifiée relativement à des faits qui font l’objet d’une enquête ou d’une instruction judiciaire, ou d’une condamnation pénale non encore irrévocable (1re Civ., 10 avril 2013, pourvoi n° 11-28.406, Bull. 2013, I, n° 77).
8. Le droit à la présomption d’innocence et le droit à la liberté d’expression ayant la même valeur normative, il appartient au juge saisi de mettre ces droits en balance en fonction des intérêts en jeu et de privilégier la solution la plus protectrice de l’intérêt le plus légitime.
9. Cette mise en balance doit être effectuée en considération, notamment, de la teneur de l’expression litigieuse, sa contribution à un débat d’intérêt général, l’influence qu’elle peut avoir sur la conduite de la procédure pénale et la proportionnalité de la mesure demandée (CEDH, arrêt du 29 mars 2016, Bédat c. Suisse [GC], n° 56925/08).
10. L’arrêt retient, d’abord, que, si le film retrace le parcours de trois personnes qui se disent victimes d’actes à caractère sexuel infligés par le prêtre en cause lorsqu’ils étaient scouts, fait état de la dénonciation de ces faits auprès des services de police et de la création d’une association rassemblant d’autres personnes se déclarant victimes de faits similaires et si, à la suite de plusieurs plaintes dont celles émanant des personnages principaux du film, M. X... fait l’objet d’une information judiciaire en cours au jour de sa diffusion en salles, ce film n’est cependant pas un documentaire sur le procès à venir et que, présenté par son auteur comme une oeuvre sur la libération de la parole de victimes de pédophilie au sein de l’église catholique, il s’inscrit dans une actualité portant sur la dénonciation de tels actes au sein de celle-ci et dans un débat d’intérêt général qui justifie que la liberté d’expression soit respectée et que l’atteinte susceptible de lui être portée pour assurer le droit à la présomption d’innocence soit limitée.
11. L’arrêt précise, ensuite, que le film débute sur un carton indiquant « Ce film est une fiction, basée sur des faits réels », informant le public qu’il s’agit d’une oeuvre de l’esprit et s’achève par un autre carton mentionnant « Le père X... bénéficie de la présomption d’innocence. Aucune date de procès n’a été fixée », que cette information à l’issue du film venant avant le générique, tous les spectateurs sont ainsi informés de cette présomption au jour de la sortie du film. Il constate, par motifs adoptés, que les éléments exposés dans le film étaient déjà connus du public. Il ajoute que l’éventuel procès de M. X... n’est pas même prévu à une date proche et qu’il n’est pas porté atteinte au droit de l’intéressé à un procès équitable.
12. Il énonce, enfin, que la suspension de la sortie du film jusqu’à l’issue définitive de la procédure pénale mettant en cause M. X... pourrait à l’évidence ne permettre sa sortie que dans plusieurs années, dans des conditions telles qu’il en résulterait une atteinte grave et disproportionnée à la liberté d’expression.
13. De ces constatations et énonciations, desquelles il résulte qu’elle a procédé à la mise en balance des intérêts en présence et apprécié l’impact du film et des avertissements donnés aux spectateurs au regard de la procédure pénale en cours, sans retenir que la culpabilité de l’intéressé aurait été tenue pour acquise avant qu’il ne soit jugé, la cour d’appel, qui n’était pas tenue de procéder aux constatations invoquées par les première et quatrième branches et à la recherche visée par la septième branche qui ne lui avait pas été demandée, a déduit, à bon droit, que la suspension de la diffusion de l’oeuvre audiovisuelle « Grâce à Dieu » jusqu’à ce qu’une décision définitive sur la culpabilité de celui-ci soit rendue constituerait une mesure disproportionnée aux intérêts en jeu.
14. Il s’ensuit que le moyen, qui manque en fait en sa troisième branche et est inopérant en ses cinquième et sixième branches qui critiquent des motifs surabondants, n’est pas fondé pour le surplus.
PAR CES MOTIFS, la Cour :

Facts and Proceedings
1. According to the ruling under appeal (Paris, 26 June 2019), delivered in interim proceedings, and according to the associated disclosure documents, Mr X was charged on 27 January 2016 with sexual offences against minors. These offences were allegedly committed between 1986 and 1991 when he was a priest in the diocese of Lyon. He also gave evidence as a “témoin assisté” (under French law, a material witness who benefits from legal representation like a defendant, but who has not been formally charged) in relation to rapes allegedly committed during the same period.
2. On 31 January 2019 he had had a summons to interim proceedings served on the companies Mandarin Production, Mars Films and France 3 Cinéma . This was done primarily to secure an “sous astreinte” injunction (in French law “sous astreinte” is a financial penalty for non-compliance with an order) to suspend the 20 February 2019 scheduled broadcast of the film “Grâce à Dieu ” through any media, until a final court ruling was made with regard to his guilt.
Review of the grounds of appeal
With regard to the eighth ground, annexed hereinafter
3. Pursuant to Article 1014, Section 2, of the Civil Procedure Code, it is unnecessary to make a ruling supported by specific reasons with regard to this ground of appeal, which is clearly not of a kind to warrant the setting aside of the ruling.
With regard to the other grounds of appeal
Statement of the grounds
4. M. X objects to the ruling to dismiss his appeal whereas:
“1/ The right to freedom of expression must be exercised while respecting the presumption of innocence. The cour d’appel (Court of Appeal) held that the measure of temporarily suspending the broadcast of the film Grâce à Dieu was disproportionate, while itself noting that this “necessarily had the consequence of representing the criminal charges extant against A....X , in such a way that their veracity appears unquestionable.” And yet the court stated neither any reason that would justify the need for the film maker to undermine Mr X’s presumption of innocence, nor the existence of any risk that the requested suspension would stymie the public interest debate to which the film contributed. For these reasons the cour d’appel violated Article 9-1 of the Civil Code, as well as Article 6, § 2, and Article 10, § 2, of The Convention for the Protection of Human Rights and Fundamental Freedoms;
2/ A person’s right to the presumption of innocence should be respected, implying that they should not be portrayed before the public as guilty . In this case, the cour d’appel expressly stated that the charges against Mr. X were represented in the film Grâce à Dieu as if they had been proven. However, the cour d’appel relied on a statement appearing at the end of the film to dismiss the serious nature of this violation of the right to the presumption of innocence: “Father X..... is considered innocent until proven guilty” and that “no trial date has been set.” This statement “informs viewers of the actual legal and judicial context”, but does not take into account the very different impact of a film compared to that of a written statement appearing for a few seconds on the screen. For these reasons the cour d’appel violated Articles 9-1 of the Civil Code and Article 6, § 2 of The Convention for the Protection of Human Rights and Fundamental Freedoms;
3/ Everyone is entitled to the presumption of innocence, including not being publicly presented as a guilty person. In addition, the cour d’appel relied on the subject matter of the film in order to dismiss the serious nature of this violation of Mr X.’s right to the presumption of innocence: The film “is not a documentary on the forthcoming trial” but rather an account of “the real-life experiences of the victims who accuse the priest, express their suffering and fight against paedophilia within the Church.” And yet the cour d’appel itself held that this choice of subject matter had precisely the effect of representing Mr. X as indisputably guilty. For these reasons the cour d’appel violated Articles 9-1 of the Civil Code and 6, § 2 of the Convention for the Protection of Human Rights and Fundamental Freedoms;
4/ The potential violation of the right to the presumption of innocence is not lessened by the partly fictitious nature of a creative work, if such a work unreservedly presents a real person as being guilty of acts subject to criminal proceedings; in addition, by relying on the fact, in order to dismiss the serious nature of this violation of Mr X.’s right to the presumption of innocence, that the film Grâce à Dieu “starts with a statement “this film is a fiction, based on real facts,” and informs the public that it is also a creative work,” (while the film fails to state that its representation of Mr X’s guilt is fictitious and should be seen as such by the viewer), the cour d’appel violated Articles 9-1 of the Civil Code and 6, § 2 of the Convention for the Protection of Human Rights and Fundamental Freedoms;
5/ Publicly expressing a bias that assumes a person being criminally prosecuted is guilty carries the inherent risk of influencing the court which has jurisdiction, regardless of the latter’s composition. The cour d’appel had noted that “if the case were to be referred to another court, it would be to a tribunal correctionnel (Criminal court for offences of medium gravity), whose professional judges have a duty to put themselves beyond any media pressure, Thus, the film’s content is not likely to violate his right to a fair trial.” In noting the foregoing, the cour d’appel violated articles 9-1 of the Civil Code and 6, § 2 of the Convention for the Protection of Human Rights and Fundamental Freedoms;
6/ the principle of impartiality requires that the courts should be perceived by defendants as the only authorities capable of judging the guilt of a person who is subject to criminal prosecution. The cour d’appel had noted that “if the case were to be referred to another court, it would be to a tribunal correctionnel (Criminal court for offences of medium gravity), whose professional judges are required to remove themselves from any media pressure. Thus, the film’s content is not likely to violate his right to a fair trial.” However, the mere fact of permitting the guilt of a person subject to criminal prosecution to be publicly demonstrated before trial is sufficient to undermine the requirement for impartiality of the courts. For these reasons, the cour d’appel violated Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms;
7/ Everyone has the right to a fair trial. The cour d’appel had held that “the release of the film on the scheduled date was not likely to constitute a serious infringement of the fairness of the trial or of the need to ensure the proper conduct of the proceedings in the criminal court, while observing that it would be otherwise if the film’s release were to coincide with judicial proceedings.” In so noting, it failed to consider whether the fact that it is possible for everyone to download or buy a copy of the film during the trial was not, in itself, of a nature to violate the right of Mr. X to a fair trial. For these reasons, the cour d’appel based its judgement on defective grounds with regard to articles 9-1 of the Civil Code, 6, § 2, and 10, § 2 of the Convention for the Protection of Human Rights and Fundamental Freedoms. "

5. According to Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms, everyone has the right to a fair trial and every person charged with an offence shall be presumed innocent until proven guilty as a matter of law.

According to Article 10 of this Convention, everyone has the right to freedom of expression, but its exercise may be subject to certain restrictions or penalties prescribed by law which are necessary measures in a democratic society. In particular, these measures include protecting the reputation or rights of others to prevent disclosure of confidential information or to ensure the authority and impartiality of the judiciary.

Pursuant to article 9-1 of the Civil Code, the judge may, even in interim proceedings, order any measures for the purpose of ending the violation of the presumption of innocence, without prejudice to compensation for damages suffered. Such an infringement is deemed to have occurred if the contentious phrases are expressed publicly and contain definitive conclusions assuming the guilt of a person who can be identified from acts which are the subject of a judicial investigation, an enquiry, or of a criminal conviction which is not yet irrevocable (1st Civ., 10 April 2013, Appeal No. 11-28.406, Bull. 2013, I, No. 77).
8. As the right to the presumption of innocence and the right to freedom of expression have the same legislative weight, it is up to the court to consider these rights against the interests at stake and to favour the solution which best protects the most legitimate interest.
9. This deliberation must take into account, in particular, the content of the contentious statements, its contribution to a debate of general interest, the influence it may have on the conduct of the criminal proceedings and the proportionate nature of the requested measure (ECHR, ruling of 29 March 2016, Bédat v. Switzerland [GC], No. 56925/08).
10. The film retraces the journey of three people who claim to be victims of sexual acts inflicted by the priest in question when they were scouts, reports the exposing of these acts to the police and the establishment of an association of other persons claiming to be victims of similar acts Following several complaints, including those from the main characters of the film, M. X is the subject of a judicial investigation in progress on the day of the film’s release in cinemas. However, the ruling firstly holds that this film is not a documentary on the forthcoming trial and that, presented by its author as a work about giving a voice to victims of paedophilia within the Catholic Church, it is part of the discussion of current events concerning the denunciation of such acts within the latter. This makes it part of a debate of general interest which justify that the film’s right to freedom of expression be respected and that any infringement of this right in order to protect the right to the presumption of innocence be limited.
11. The ruling then specifies that the film begins with a message stating “This film is a work of fiction, based on real events,” informing the audience that it is a creative work and ends with another message stating that “Father X is innocent until proven guilty. No trial date has been set.” This information at the end of the film appears before the credits. Therefore, all viewers are informed of this presumption of innocence on the day of the film’s release. The rule notes,via previously established grounds, that the details presented in the film were already in the public domain. It adds that the possible trial of Mr. X is not even scheduled for the near future and that his right to a fair hearing at that trial is not infringed.
12. Finally, it states that the suspension of the film’s release until the final outcome of the criminal proceedings against Mr X could obviously only allow its release in several years, in which case a serious and disproportionate infringement of the freedom of expression would result.
13. From these findings and statements, the cour d’appel proceeded to balance the interests at stake and considered the impact of the film and the warnings given to viewers in relation to the ongoing criminal proceedings, and the cour d’appel found that the guilt of the person concerned would not have been assumed before he was tried. In so doing, the cour d’appel, which was not required to deal with the observations made under the first and fourth grounds or to consider the matters of the seventh ground, such a request having not been made of it, correctly found that suspending the broadcast of the audiovisual work “Grâce à Dieu” until a final ruling on his guilt was made would be a disproportionate measure with respect to the interests at stake.
14. It follows that the grounds of appeal, of which the third ground is in fact incomplete and the fifth and sixth are superfluous and ineffective, are unfounded.
ON THESE GROUNDS, the Court:
DISMISSES the appeal;
