‘함정’이란 용어는 법정에서 변호사가 자신이 변론하는 사람의 혐의를 벗겨주기 위해 자주 사용해온 말이다. 그런데 사이버공간에도 ‘함정’이 있을까. 결론부터 말하자면‘함정’은 사법당국이 사이버범죄자를 잡기 위해 자주 사용하는 수법으로 드러났다.
이 사실이 밝혀진 곳은 지난주 캘리포니아 패서디나에서 열린 한 순회법정. 미성년 매춘범을 잡기 위해 사이버공간에서 성 구매자인양 위장근무를 하고 있던 경찰이 마침 성 파트너를 구하던 한 동성애자를 붙잡은 것. 그러나 법정은 경찰이 ‘부적절한 함정‘을 이용했다는 이유로 동성애자에게 무죄판결을 내렸다.
Translation - English

The term of ‘trap’ was often used by lawyers to exculpate defendants from a charge in court. However, is there any ‘trap’ in the cyber space? To tell the conclusion first, ‘trap’ turned out to be a commonly used trick for the judicial authority to catch cyber criminals.
This fact was revealed in one assize court in Pasadena, California last week.
A police man seized a homosexual who was looking for a sexual partner while he disguising as a buyer to hunt the underage prostitution in the cyber space. However, the court declared the homosexual not guilty because the policeman used ‘an inappropriate trap’.

It was the morning of March the 1st when 75 years old- Mr. Chun went out looking for fire wood. He walked along the trail for 2.5 km into the forest and climbed a steep hill. Having gathered firewood, Mr. Chun started the trip back home in the afternoon. The problem was that the rain was sprinkling for a while in the morning. It was a slippery graveled path. Mr. Chun fell off and tumbled down the slope. He lost his consciousness. When he regained his consciousness, it had already grown very dark. He felt intolerable pain in his left leg. Noticing that his leg was red and, he knew his leg was broken at a glance. Mr. Chun cried out for a help, however there was no one to help him in the deep forest at night. Realizing that he would get no help, Mr. Chun started to crawl up dragging his broken leg along. He managed to work his way up to the path but he could not stand up. Mr. Chun started to crawl on the gravely trail on his belly. When night fell, it began to pour. The mountain path became muddy.

75세인 천 노인이 땔감을 장만하기 위해 집을 나선 것은 3월 1일 오전 이었습니다. 그는 산길을 따라 2.5킬로미터나 산속으로 들어갔습니다. 가파른 산 고개 하나를 넘었습니다. 땔감을 마련한 천 노인은 그날 오후 집으로 돌아오는 길에 올랐습니다. 오전 한동안 흩뿌렸던 비가 문제였습니다. 자갈길이라 미끄러웠습니다. 천 노인은 자빠지면서 길 옆 비탈로 굴렀습니다. 그대로 기절해버렸습니다.천 노인이 다시 깨어났을 때는 이미 사방이 캄캄해진 뒤였습니다. 왼쪽 다리에 참기 어려운 통증이 몰려왔습니다. 벌겋게 부어오른 모습으로 미루어 보아 부러졌음을 한 눈에 알 수 있었습니다. 천 노인은 '살려 달라'고 외쳤습니다. 하지만 한밤의 깊은 산 속에 사람이 있을 리가 없었습니다. 도저히 다른 사람의 도움을 받을 수 없다는 사실을 깨달은 천 노인은 부러진 다리를 질질 끌며 기어오르기 시작했습니다. 가까스로 산길까지 올라왔지만 몸을 일으킬 방법이 없었습니다. 천 노인은 포복을 하듯 자갈투성이 산길을 기어가기 시작했습니다. 밤이 깊어지자 폭우가 쏟아지기 시작했습니다. 산길은 진창으로 변했습니다.
